1. Service Agreement
Our services include garden design, maintenance, installation, and landscaping solutions tailored to meet your specific needs. All services are subject to availability and may be adjusted based on project requirements.
1.1 Scope of Work
- Design: Creation of garden layouts, plant selection, and aesthetic planning.
- Maintenance: Regular upkeep including mowing, pruning, and fertilizing.
- Installation: Implementation of hardscaping elements such as patios, paths, and water features.
2. Pricing and Payment Terms
All prices are quoted based on the scope of work outlined in the project proposal. Prices are subject to change if there are alterations to the project scope.
2.1 Payment Schedule
Payments are to be made in installments as follows:
- Deposit: 30% upon acceptance of the proposal.
- Mid-Project Payment: 40% upon completion of 50% of the work.
- Final Payment: 30% upon project completion.
3. Cancellation and Refunds
Clients may cancel the project at any time. Refunds will be processed based on the work completed up to the cancellation date, minus any non-recoverable expenses.
3.1 Notice Period
A minimum of 7 days' notice is required for project cancellation. Failure to provide adequate notice may result in forfeiture of the deposit.
4. Client Responsibilities
Clients are responsible for providing access to the property, ensuring the site is prepared for work to commence, and communicating any changes to the project scope promptly.
4.1 Site Conditions
The client must ensure that the work area is free from hazards and complies with local regulations. Any issues arising from site conditions not disclosed prior to the commencement of work may result in additional charges.
5. Warranty and Liability
We guarantee the quality of our workmanship for a period of 12 months from the date of project completion. This warranty covers defects in materials and labor but does not include damage caused by extreme weather, misuse, or unauthorized alterations.
5.1 Limitation of Liability
Our liability is limited to the total value of the project. We are not liable for any indirect, incidental, or consequential damages that may arise during the project.
6. Intellectual Property
All designs, plans, and related materials produced by Landscapers Earls Court remain our intellectual property. Clients are granted a non-exclusive license to use these materials for the intended project purposes only.
6.1 Use of Materials
Clients may not reproduce, distribute, or create derivative works from our designs without prior written consent.
7. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the updated terms.

8. Governing Law
These terms and conditions are governed by the laws of England and Wales. Any disputes arising from our services will be subject to the exclusive jurisdiction of the courts in Earls Court.

In the event of a force majeure, we will notify the client as soon as possible and work towards rescheduling the project.
11. Severability
If any provision of these terms and conditions is found to be unenforceable or invalid, the remaining provisions will continue to be in effect.

Any amendments to these terms and conditions will be documented and communicated to the client for acceptance.
12. Entire Agreement
These terms and conditions constitute the entire agreement between the client and Landscapers Earls Court. They supersede all prior discussions, agreements, or understandings related to the project.
12.1 No Waiver
Failure to enforce any part of these terms does not constitute a waiver of our rights to enforce them in the future.
